Can I Lose My House If My Company Goes Into Liquidation?
For most directors, the answer is no - a company's liquidation does not, by itself, put your home at risk. But there are important exceptions where your property can be exposed, and understanding them is essential.
When Your Home Is at Risk
Your house may be at risk if:
You've Signed a Personal Guarantee Secured Against It
If a bank or lender required a charge over your home as security for a company loan or overdraft, and the company cannot pay, the lender can enforce that charge. This is the most common way a director's home becomes exposed.
You Are Found Personally Liable
If a court finds you personally liable - for example, for wrongful trading, an overdrawn loan account, or fraudulent trading - and you cannot pay from other assets, a creditor could obtain a charging order over your home.
You've Used Personal Assets to Fund the Company
If company debts have been run up using personal credit cards or loans in your name, those are your personal debts regardless of the liquidation.
When Your Home Is Safe
Your home is generally not at risk where:
- The company's debts are the company's own - limited liability protects you
- You have not signed a personal guarantee secured against the property
- There is no finding of wrongful or fraudulent trading
- You have not used personal borrowing to fund the company
How to Protect Yourself
- Identify all guarantees and security over your home before liquidation
- Take advice early - acting responsibly once insolvency is apparent protects against wrongful trading
- Keep company and personal finances separate
- Review your mortgage and loan documents for any personal guarantees you may have forgotten
